Kanuni Kuu 5 Zinazokuathiri kama Mkopaji

1. Leseni ya CBK Ni Lazima

Tangu Septemba 2022, programu yoyote inayotoa mkopo wa dijitali Kenya lazima iwe na leseni ya CBK. Kupitisha mkopo bila leseni = faini hadi KES 10,000,000 au jela miaka 5.

Jinsi ya kuangalia: Tembelea centralbank.go.ke → "Digital Credit Providers" → Angalia orodha. Ikiwa programu HAIPO = usiitumie.

2. Uwazi wa Gharama (Transparency)

Mkopeshaji lazima akuonyeshe KABLA ya kukubali mkopo:

  • APR (Annual Percentage Rate) — riba kwa mwaka mzima
  • Jumla ya gharama — mkopo + riba + ada zote
  • Ratiba ya malipo — tarehe na kiasi cha kila malipo
  • Adhabu za kuchelewa — gharama za ziada ikiwa unachelewa
  • Haki ya kufuta — siku 2 za "cooling-off" kufuta mkopo bila adhabu

3. Ulinzi Dhidi ya Digital Shaming

CBK Digital Lending Regulations, Section 31 — inazuia mkopeshaji:

  • Kutuma ujumbe kwa contacts zako kuhusu deni lako
  • Kupiga simu familia/marafiki zako kuhusu mkopo wako
  • Kupost kwenye mitandao ya kijamii kuhusu deni lako
  • Kutumia lugha ya vitisho au aibu

4. Haki za Data na Faragha

Pamoja na Data Protection Act 2019:

  • Ridhaa ya wazi — lazima wakuulize kabla ya data yako
  • Haki ya kupata — unaweza kuomba nakala ya data yako yote
  • Haki ya kufuta — unaweza kutaka data ifutwe baada ya kulipa
  • Kuzuia data harvesting — contacts/picha/SMS ni HIARI, si lazima

5. Uripoti wa CRB Wenye Uwajibikaji

Kanuni mpya zinahitaji:

  • Mkopaji aarifiwe KABLA ya kuandikwa CRB (siku 30 notice)
  • Mkopaji awe na njia ya kupinga kuandikwa (dispute mechanism)
  • CRB listing fupi zaidi kwa kiasi kidogo (KES 200 isiharibu miaka 5)
  • Zinatekelezwa polepole — si programu zote zinafuata bado

Haki Mpya za Wakopaji 2026

✅ Haki ya Cooling-Off

Siku 2 za kufuta mkopo bila adhabu baada ya kukubali. Rudisha kiasi kamili = mkopo umefutwa.

✅ Haki ya Kulipa Mapema

Unaweza kulipa mkopo kabla ya tarehe bila ada ya ziada (prepayment penalty imekatazwa).

✅ Haki ya Taarifa Kamili

Lazima uonyeshwe gharama zote, APR, na masharti KWA LUGHA YA KISWAHILI pia.

✅ Haki ya Malalamiko

CBK itachunguza malalamiko ndani ya siku 30. Bure, bila mawakili.
